How You Can Deduct Your HOA Fees

Tax Season

How you can deduct your HOA fees

Its tax season again and as we all look to minimize Uncle Sam’s cut one thing we frequently overlook are our HOA fees.  Unfortunately, HOA fees themselves unfortunately cannot be deducted directly.  They are a cost of the house and simply the price to own the home in your neighborhood.  However, if you rent your home out they are deductible as a rental cost.  They must be paid but for a rental property they can be written off.  Another deduction allotted for HOA fees is if you have a home office.  That makes a portion of them a work expense.  The write off amount is directly related to the portion of the home that the office utilizes.  For instance if your home office is 140 sq/ft and your homes total sq/ft is 1,400 that means the office is 10% of the total.  So 10% of the HOA fees can be written off.  Don’t miss out on this opportunity to be diligent and save.

Reduced Speed Limit in Memorial Parkway

Texas Transportation Code, authorizes the Commissioners Court of a county to declare a speed limit lower than 30 MPH in a residence district, unless the roadway has been designated as a major thoroughfare. The Memorial Parkway HOA is considering petitioning the Commissioners court for a reduced speed limit of 25 mph within Memorial Parkway Subdivision. We would like to survey the members of the subdivision before making a decision. We have created a simple survey to see if there is support to have the speed limit lowered.

Based on the survey results, the HOA will request an engineering study from Harris County to determine which streets in the subdivision are eligible for 25 MPH speed limits. After receiving the study results and if the HOA Board chooses to move forward they should provide a petition to the Precinct Three Commissioners in the prescribed form. The petition must be signed (in person) by at least 51% of the owners or tenants of residences in the subdivision. There can only be one per household sign the petition. That means we will need 1,132 of the homes come and sign the petition.
